Supreme Court of Canada won’t hear Malley appeal

The Supreme Court of Canada will not hear the appeal of Brian Malley.

The Red Deer man was convicted of first-degree murder in the 2011 bombing death of Innisfail mother Vicky Shachtay.

In a release Thursday, Canada’s top court said leave to appeal the conviction is denied. As is typical, the court did not provide reasons for its decision.

Shachtay was 23 when she was killed instantly after opening a pipe bomb disguised as a Christmas present while at her Innisfail apartment on Nov. 25, 2011.

A Red Deer jury convicted Malley in February 2015 following a lengthy trial in which the Crown argued Malley, Shachtay’s financial adviser, killed her after squandering hundreds of thousands of dollars she’d received in a settlement following a 2004 accident that left her confined to a wheelchair.

The defence had argued that someone other than Malley may have left the bomb as a message to Shachtay, or other members of her family.

The Alberta Court of Appeal dismissed an application by Malley in June 2017.
