Environmental Appeals Board hearing for Burnco Rock Products Ltd.

Alberta’s Environmental Appeals Board will conduct a virtual hearing next year regarding activities involving a Red Deer-based company.

The hearing will take place on March 11, 12 and 13, 2026.

Government officials say the Board will hear submissions with respect to the Jan. 12, 2024 decision of the Director, Alberta Environment and Protected Areas, to issue Water Act Approval DAUT0014236 to BURNCO Rock Products Ltd. authorizing the placing, constructing, operating, maintaining, removing, disturbing works, in or on any land, water or water body; maintaining, removing or disturbing ground vegetation or other material in or on any land, water or water body; altering flow, direction of flow or level of water and to disturb groundwater and manage water subject to the terms and conditions in the Approval, at the following land locations near Cochrane, Alberta: NE15-26-05 W5M, N/2 14-26-05 W5M, NE 13-26-05 W5M, SE 24-26-05 W5M, SE 13-26-05 W5M, SW 18-26-04 W5M, NW 18-26-04 W5M, SW 19-26-04 W5M, SE 18-26-04 W5M, NE-18-26-04 W5M, NW 13-26-05 W5M.

Provincial officials note, the Environmental Appeals Board is a separate and independent body that reviews certain decisions made by Alberta Environment and Protected Areas. The Board is composed of environmental experts from a variety of disciplines.

Officials say any person, other than the parties, who wishes to make a representation before the Board on this appeal must submit a request by fax or by e-mail to the Board. The request must be received by the Board on or before Jan. 9, 2026. It is the applicant’s responsibility to ensure that their request has been received.

Officials say the request shall (a) contain the name, address, e-mail, and telephone and fax numbers of the person submitting the request, (b) indicate whether the person submitting the request intends to be represented by a lawyer or agent and, if so, the name of the lawyer or agent, and (c) contain a summary of the nature of the person’s interest in this appeal.

According to the government, applications will only be considered if the information will assist the Board in making its decision and will not duplicate the information provided by the parties. After Jan. 9, 2026, the Board will determine if other persons may make representations and the manner in which they can be made.

The province says the information requested is necessary to allow the Environmental Appeals Board to perform its function. Officials say the information is collected under the authority of the Protection of Privacy Act, SA 2024, c P-28.5, sections 4(c), 5(1)(p), and 5(2) for the purposes of administering the Environmental Appeals Board’s appeals program. The collection of personal information is authorized pursuant to section 5 of the Environmental Appeal Board Regulation.
