Ponoka interim bylaw bans cannabis smoking and vaping in public places

Oct 16, 2018 | 2:20 PM

The smoking or vaping of recreational cannabis in public places will not be legal in the Town of Ponoka following the legalization of cannabis October 17.

Town officials say an interim Cannabis Consumption Bylaw received third reading by council last week. It prohibits smoking or vaping of recreational cannabis in public places.

‘Public places,’ officials say, means any property – whether publicly or privately owned – to which members of the public have access, either by right or by invitation (express or implied). This includes any outdoor area or part of a building or structure.

Ponoka’s Cannabis Consumption Bylaw is described as an interim measure that will remain in place until the Town has completed public consultation on the question of public consumption of cannabis and what local citizens feel should be allowed in the community.

Once public consultation is completed, council will make a final decision on how it will regulate public consumption of cannabis over the long term.

Options include making the interim Cannabis Consumption Bylaw permanent (with possible revisions) or introduce new cannabis regulations into the Town’s Community Standards Bylaw. Council could also choose to follow provincial cannabis regulations that allow people to smoke or vape cannabis in some public places where smoking tobacco is allowed.

Provincial legislation sets minimum rules and regulations for cannabis consumption in Alberta and municipalities have the authority to implement stricter regulations if they choose.

Ponoka residents are now being encouraged to fill out a Citizen Input Survey on how best to regulate public consumption of cannabis in Ponoka over the long term and offer input on a proposed Community Standards Bylaw for the Town.

The survey is available at the Town office on 54 Street and on the Town website at www.ponoka.ca until October 31. You’re asked to click the link that appears below ‘Public Consultation on Community Standards Bylaw and Public Consumption of Cannabis’.

Please note the Town of Ponoka Administrative Offices will move to the new Ponoka Civic Building on October 23 at #200, 5604-50 St.
