Charges withdrawn for one of two accused in alleged assault with firearm incident
One of two people charged in connection with an assault in Ponoka this spring where a gun was allegedly pointed at the victim, has had their charges withdrawn.
Randy Kale Potts, 31, of Maskwacis, had all 10 counts against her withdrawn in Ponoka provincial court on Aug. 26, 2022.
According to the Assistant Deputy Chief Crown prosecutor with the Wetaskiwin Regional Crown office, there was no reasonable likelihood of conviction against Potts.
“The Crown has an obligation to constantly assess their file to ensure that the case meets the prosecution standard of reasonable likelihood of conviction and public interest in proceeding. Reasonable likelihood of conviction is a higher standard than the police must meet in order to lay a charge – the police standard is reasonable and probable grounds.
