Woman fined $1,000 in fatal hit and run with cyclist on Sunchild Road

A woman charged in a fatal hit and run involving a cyclist on the Sunchild Road two years ago has been fined $1,000.

Candace Chipaway, 33, pled guilty in Rocky Mountain House provincial court last week to failing to remain at the scene of an accident.

According to a spokesperson with Alberta Justice and Solicitor General, the Crown prosecutor reviewed and assessed all the available evidence and determined there was no reasonable likelihood of conviction for the offence of driving a motor vehicle while unauthorized.

Chipaway was originally charged with failing to remain at the scene of an accident causing death, and another count under the Traffic Safety Act (TSA).

“There was a reasonable likelihood of conviction on the Traffic Safety Act charge, so the Crown prosecutor accepted the plea,” reads a statement provided to rdnewsNOW. “The prosecutor came to the conclusion that the Crown was unable to prove the Criminal Code charges to the standard required because of the discrepancies in the evidence around who was driving. As a result the matter was resolved with a plea to the provincial offence charge.”

It was on July 29, 2019 at 6:32 a.m. when Rocky Mountain House RCMP received a complaint of a male in the ditch on the Sunchild Road. Mounties located the male, 33-year-old Andrew Frencheater, who was confirmed to be deceased.

An abandoned vehicle was located nearby and seized for investigation. An RCMP collision analyst and Red Deer RCMP Forensic Identification Section attended to conduct a scene examination.

Police say several interviews were conducted and a suspect identified. Investigation revealed that Frencheater was riding his bicycle when he was struck by the vehicle. It is believed the collision occurred sometime before midnight on July 28.
