Conditional Sentence Order for man charged in Sylvan Lake weapons complaint

A central Alberta man charged in a Sylvan Lake weapons complaint has been given a 15-month Conditional Sentence Order (CSO) and 10-year firearms prohibition following the conclusion of his trial in Red Deer Court of King’s Bench this week.

Kole Albert Prodaniuk, 26, was also ordered to pay a total of $400 in surcharges and fined $100 after being convicted on counts of pointing a firearm (CC 87(1)), and possession of substance (under the Controlled Drug & Substances Act).

A second individual charged, Lee Michael Falsetta, 36, was sentenced in Red Deer provincial court on Jan. 20, 2022, to five days in jail and 18 months of probation. Counts of possession of a controlled substance and fail to comply with probation orders were withdrawn.

Prodaniuk was originally charged with pointing a firearm, possess a weapon for a dangerous purpose, possess property obtained by crime under $5000, two counts of possess a controlled substance for the purpose of trafficking, drive carelessly, and operate motor vehicle without license in possession, in the incident last year.

It was just after 8 p.m. on July 7, 2021 when RCMP responded to a report of a male pointing a firearm. A specific location, however, was not provided.

Police say it was reported at the time that a vehicle sped through an area with heavy pedestrian traffic when the eventual victim yelled at the driver to slow down.

“The driver stopped his vehicle and confronted the victim. As the victim left the area, the driver pointed what appeared to be a firearm at him,” stated a release from Sylvan Lake Mounties. “Sylvan Lake RCMP responded immediately to the area and located the vehicle.”

Police said at the time their subsequent investigation resulted in the seizure of methamphetamine and cocaine, as well as an airsoft pellet gun.
