Charges stayed in alleged sexual assaults involving youth

There has been a stay of proceedings for a Red Deer man charged in a pair of alleged sexual assaults nearly three years ago.

Momodou Lamin Bah, 33, had a stay of proceedings on his matters in Red Deer Court of Justice on Jan. 22, 2025.

According to the Alberta Crown Prosecution Service (ACPS), a key duty of a Crown prosecutor is to assess cases on an ongoing basis and ensure all aspects of the file are carefully considered at every stage of a prosecution.

In general, says the ACPS, Crown assessment of files continue to evolve after the initial decision is made to lay charges.

“The goal of all criminal prosecutions is a fair and just outcome; this can take many forms depending on the circumstances of the case and includes outcomes such as a conviction, a stay/withdrawal, alternative measures, or a Peace Bond,” reads a statement from ACPS. “In this matter, it was ultimately determined that a stay of proceedings was the appropriate outcome given the delay caused by an inability to secure interpretation and the charges were stayed on January 22, 2025.”

Bah was charged with sexual assault in relation to an alleged incident in Red Deer on April 14, 2022. He was also charged with two counts of sexual assault/under 16 years, two counts of sexual contact with child, two counts of sexual counsel of child, and fail to comply with a release order in relation to an alleged incident in Red Deer involving two victims on Aug, 2, 2022.

According to Red Deer RCMP, the alleged Aug. 2, assault involved youth victims aged 13 and 14.
