Stettler man convicted of accessing child pornography, sentenced to 20 months

A Stettler man convicted of accessing child pornography has been sentenced to 20 months in jail.

Daniel Benjamin Penner, 37, was sentenced in Stettler Court of Justice on Sept. 23, 2024, after also being found guilty of possession of firearm knowing its possession is unauthorized, and fail to comply with prohibition.

Penner, however, was given credit for seven months of pre-trial custody, meaning he has a total of 210 days left to serve as of Sept. 23. He was also given a five-year firearm prohibition during sentencing.

He was charged after police searched a local residence and seized electronics containing child sexual abuse materials.

In Oct. 2023, ALERT’s Internet Child Exploitation (ICE) unit began an investigation into an individual allegedly in possession of child sexual abuse materials.

On Feb. 21, 2024, members of the Stettler RCMP Detachment, ALERT (Alberta Law Enforcement Response Team) and ICE, executed a search warrant at a residence in Stettler.

During the search, police said they located and seized electronics and other storage devices that provided evidence to support charges for transmitting, accessing and possession of child pornography as well as unauthorized possession of firearms and breach of a prohibition order.

Daniel Benjamin Penner was originally charged with:

  • Transmit child pornography
  • Accessing child pornography
  • Possession of child pornography
  • Unauthorised possession of a firearm
  • Breach of probation order

Police said at the time, that Penner was on probation for similar charges from an investigation and conviction in 2020.
