Height relaxation approved for mixed-use building coming to Lakeshore Drive in Sylvan Lake

Sylvan Lake’s town council has unanimously approved a development permit for a mixed-use building to be located at 4515 Lakeshore Drive, which was seeking relaxations on a variety of the development requirements.

Council has approved a height restriction relaxation to allow for five stories rather than four, a reduction in the number of parking stalls from 54 to 47, and a reduction of the minimum parking stall length from 5.5 metres to 4.8 metres on eight stalls to be designated for small cars.

Although the developer is requesting permission to build an additional floor than is typically permitted, it has reduced the height between each floor to bring the total building height to 17.99 metres. This is less than the maximum 21 metres allowed with a four storey building designed with the maximum height allowance between each floor.

The proposed building is expected to house retail and commercial operations on the ground floor and 43 residential units in the floors above. Units proposed include 29 1-bedroom units, 11 2-bedroom, and three 3-bedroom units.

The Sustainable Waterfront Area Redevelopment Plan (SWARP) recommends a parking stall ratio of 1.25 stalls per one- to three-bedroom apartment. Under SWARP, this development requires 54 stalls. However, previous developments within the Waterfront Direct Control District have only been required to provide one parking stall per unit, which in this case would only be 43 stalls.

The applicant has also proposed six bicycle stalls, while only three are required.

Two residents indicated the development would block their view of the lake.

The following conditions have been placed on the development:

1. Prior to issuance of the development permit the applicant shall:

a. Enter into a Development Agreement with the Town to address municipal
improvements, including the collection of applicable fees and/ or off site levies;

b. Submit a grading plan for Town approval;

c. Submit a stormwater management Plan; and

d. Submit a Servicing and Utility Plan.

2. The location of the proposed building shall be in accordance with the approved site plan, any changes shall require a separate development permit application.

3. The final appearance of the building on site shall be in accordance with the approved building elevations. Any changes to the elevations shall require a separate permit.

4. All construction materials, supplies, and equipment are to be stored on the property and not on the public roadway.

5. The lane access to the site is to be paved from 46 Street east to the easterly corner of the property.

6. The developer ensuring the continuous cleanup of construction debris tracked onto the public roadway where access is provided to the property.

7. The applicant shall ensure:

a. Compliance with all Federal, Provincial and Municipal statutes, regulations and
Codes;

b. Compliance with the Town’s Land Use Bylaw # 695/2015.

c. All development is located outside active utility Right-of- Ways and easements.

8. No vehicular access is permitted to the parcel from Lakeshore Drive.

9. The applicant apply for a demolition permit for the removal of the existing building on the property.
