Former health care employee pleads guilty after sharing unsolicited photos of residents

A former employee working at the Lamont Health Care Centre has admitted to taking photos of three long-term care residents back in 2019.

Kathryn Starzynski plead guilty on December 9, 2022, to taking photos of the individuals and using a bug-eye filter to alter the image of one of the residents.

She then reportedly shared the altered photo with a colleague and posted the other two photos on one of her social media accounts.

Under the Health Information Act (HIA), it is an offence to knowingly disclose health information.

Starzynski has received a conditional discharge and was placed on probation with conditions for the next 12 months, including advising any potential employer about the conviction if the prospective employment involves accessing health information.

She was also sentenced to 30 hours of community service.

The Office of the Information and Privacy Commissioner (OIPC) opened an investigation into Starzynski’s actions in May 2020 after the Lamont Health Care Centre reported its findings.
