Pandemic delays No Landfill Disposal Facility in Sylvan Lake

The worldwide COVID-19 pandemic is causing delays for the Town of Sylvan Lake in having its planned No Landfill Disposal Facility up and running by year’s end.

On Monday, town council learned of a recent request from FogDog Energy Solutions Incorporated to have the deadline extended for all operating approvals to be in place from Jun. 15, 2020, to Dec. 31, 2020.

The company also asked for the facility’s previously agreed upon start-up date to be extended by one year to Dec. 31, 2021.

Officials with Fogdog say the coronavirus outbreak is causing major delays in all aspects of the process.

“Some departments or companies that we have been working with have now gone into a complete or partial shutdown,” Marlin Leehim of Fogdog Energy Solutions wrote in a letter to the Town of Sylvan Lake. “Engineering is being done across borders both internationally and locally, this too is now impacted. Italy is under tremendous problems and the supply chains are also severely suffering the same fate.

“Nobody expected this level of chaos and we are doing as much as we possibly can to get things finalized,” he added, “But the fallout of the coronavirus pandemic is affecting our process to be fulfilled in a timely manner with the Town of Sylvan Lake.”

On Monday, town council authorized CAO Wally Ferris to negotiate and finalize details of the proposed amendment to the Master Services Agreement (MSA) between Fogdog Energy Solutions Incorporated and the Town of Sylvan Lake for the facility, and execute the amendment at his discretion and that the amendment be co-signed by the Mayor as presented.

Administration is also proposing that Fogdog provide regular written updates on the status of the project, including investments and financing, approvals and further impacts of the pandemic.

The Town will also propose to include a clause in the amendment requiring Fogdog Energy take reasonable and lawful mitigation from the impacts of the coronavirus pandemic during the construction and eventual operation of the facility.

Town officials suggest there are no anticipated financial implications as a result of the proposed amendment to the MSA since the 2020 budget includes the status quo operation of all waste services.

Once the Town approves and executes the new amendment, administration will be required to enact the third year of a two-year plus one-year option for the waste services contract with Waste Connections of Canada, the current contractor responsible for the servicing of the garbage and recycling dumpsters at the town’s two recycling facilities and Waste Transfer Site.

That contract is set to expire on Oct. 31, but will require enacting the option year providing services through to Dec. 31, 2021, coinciding with the new facility service start-up date in the amendment.
