Appeal filed for Red Deer man convicted in 2017 stabbing

An appeal has been filed for a Red Deer man convicted in a 2017 stabbing incident.

Alberta Justice confirms that a Notice of Appeal was received on Jan. 28 for Linden Joseph Lee Buffalo, 30, who was convicted of aggravated assault and mischief under $5000 in May 2019, and later sentenced to time already served along with a $500 fine.

According to lawyer Andrew Phypers, Buffalo’s aggravated assault conviction is being appealed.

Buffalo’s conviction was for an August 2017 incident in which the father of his now ex-girlfriend was stabbed in the neck and hip before suffering a hand injury while trying to wrestle away a knife during an altercation.

Court heard the incident took place at Buffalo’s residence in Oriole Park after a long night of drinking when he and his common-law wife began to argue over Buffalo’s alleged interactions with other women at a bar that night.

The argument escalated to a point where Buffalo’s wife locked herself in a bathroom and contacted her father for help.

He arrived soon afterwards, punching Buffalo in the face while Buffalo lay in his bed pretending to sleep – resulting in a fight between the two men and involving a knife.

Buffalo was originally charged with attempted murder before being convicted on the lesser charge of aggravated assault.

When rendering her decision on May 3, Madam Justice Marilyn D. Slawinsky told court she felt Buffalo acted unreasonably after the first two knife blows to his father-in-law.

Slawinsky indicated Buffalo should have known his father-in-law was not an intruder as claimed in his defense, after repeated attempts to identify himself to Buffalo during their fight.
