Town of Rocky to make mobile home park owners responsible for collecting property taxes

The Town of Rocky Mountain House has passed first reading on a bylaw that would make owners of mobile home parks responsible for collecting property taxes from the residents who live in them.

The parks affected by the Manufactured Homes Property Tax Transfer Bylaw include Evergreen Mobile Home Park, Rocky Mountain House Estates – Mobile Home Park, Southside Trailer Court, Sportsman Trailer Court, and Town Centre Mobile Home Park.

The intent of the bylaw is to simplify and streamline the assessment and collection of property taxes for a designated manufactured home (DMH) owner in a manufactured home community, park or court (MHC), according to town officials.

Director of Corporate Services Betty Quinlan says other municipalities are implementing comparable bylaws, including Clearwater County.

The MHC owner would be fully responsible to pay taxes on all properties and it would be up to them to pass the costs onto their residents in a manner they see fit

The park owners will be provided with tax amounts from the town for each property, plus a total cost that will be required.

“The earliest the Bylaw could take effect, is it has to be in place for twelve months, so if it passes this December then the earliest it could take effect is 2021,” says Quinlan.

According to the Municipal Government Act, MHC owners are to inform the town of any alterations to contact info or any other major changes to a DMH, including if they move, which the town states does not always happen.

When it does, since there is no exchange in land involved, they don’t always have to go through a lawyer and get a statement of adjustments which doesn’t trigger a tax search, so a new property owner can move in, unaware that there are outstanding property taxes owed, which could include large arrears.

“A public hearing is not required for this type of bylaw, although we have published that notice in the local paper,” Communications Coordinator Laura Button stated on the matter of further readings.

“Council is providing a period of notice to the community owners, and that is underway right now, the letters have gone out.”

Second reading will be brought up back to council on December 3.
