MacIntyre waives right to preliminary inquiry

Don MacIntyre, the former Innisfail-Sylvan Lake MLA facing sex-related charges, has waived his right to a preliminary inquiry.

A preliminary inquiry is used to determine if there is enough evidence for a case to go to trial in a higher court.

MacIntyre’s next court date has not yet been scheduled.

The 62-year-old was serving his first term as MLA for Innisfail-Sylvan Lake when he resigned in February after being charged with sexual assault and sexual interference.

The Criminal Code of Canada defines sexual interference as a charge related to a person who, for a sexual purpose, touches, directly or indirectly, with a part of the body or with an object, any part of the body of a person under the age of 16.

MacIntyre is not currently in custody but must abide by several conditions which include that he have no contact with anyone under 16 without a guardian present. He must also stay at least 100 metres away from a playground, public swimming pool, daycare or school yard.
