Red Deer RCMP cleared by ASIRT in March 2017 incident

Red Deer Mounties have been cleared by the Alberta Serious Incident Response Team of any wrongdoing during an arrest in March 2017.

On March 13, 2017, RCMP received a call about a dispute between roommates.

Two members responded to the address and while dealing with the subject of the complaint – a 32-year-old man in a wheelchair – it was determined that he was wanted on an outstanding warrant out of Calgary.

He then had to be transported to the detachment in order to appear before a Justice of the Peace.

The man accompanied RCMP to a police vehicle where he was assisted into the back seat. The man instructed officers how to disassemble his wheelchair, which was then loaded into another police vehicle. They were both then taken to the detachment.

There, the man stayed the night before leaving in a taxi the next morning following a judge releasing him on bail.

ASIRT says it was later that day the man noticed bruising on his leg. He then went to Red Deer Regional Hospital where it was determined he had a broken femur.

ASIRT’s investigation has determined Red Deer RCMP acted lawfully during the man’s arrest and were required to transport him prior to his release. During the arrest, no force was used and there was no criminally negligent actions taken by any officer.

While it remains uncertain, ASIRT continues, how the man suffered the injury, none of the RCMP’s conduct was unlawful or would warrant criminal charges.

ASIRT’s mandate is to effectively, independently and objectively investigate incidents involving Alberta’s police that have resulted in serious injury or death to any person, as well as serious or sensitive allegations of police misconduct.
