Sylvan Lake updating Community Standards Bylaw

Updates to Sylvan Lake’s Community Standards Bylaw were given first reading this week by town council.

The changes, if given full approval, would set out new rules for live entertainment on unlicensed commercial patios and address the maintenance of trees and shrubs on Town land adjacent to private property.

First, no live entertainment is permitted on an unlicensed commercial patio from 9 p.m. to 9 a.m. Monday to Sunday. The same can be said for 11 p.m. to 9 a.m. from Thursday to Saturday and on Sunday when the Monday is holiday, but the special times for later in the week only apply from June 1 to September 30.

As well, unlicensed commercial patios may not be used as a dance floor by patrons, nor can it be utilized for adult entertainment.

These standards mirror similar clauses in the recently enacted Licensed Food and Beverage Establishment Bylaw.

Another change cleans up language around a property owner’s ability to manage grass, weeds or other landscaping features which are adjacent to his/her property. The Town believes the current bylaw could lead some property owners to believe they have a right or responsibility to alter Town-owned foliage.

Fine amounts are not being changed.

Town administration also provided council with a graph which shows the most common violations of the Community Standards Bylaw since July 2010.

There have been 350 incidents (or 18 per cent) of residents failing to cut, maintain, or control their grass, weeds or shrubbery.

There were another 334 cases (or 17.1 per cent) of failing to properly store, accumulate or dispose of loose garbage. Failure to remove snow and failure to destroy or control noxious weeds are the next two items on the list at 9.3 per cent and 6.7 per cent, respectively.
