Fleig retrial for 2009 shooting murder delayed to 2019

A second trial for a man convicted in a gang-style drive-by shooting in Red Deer has been delayed even further.

Christopher Fleig, who is now 33, is charged in the death in April 2009 of Brandon Prevey.

The 29-year-old, a well-known criminal in Red Deer and Edmonton, was shot seven times while in his car in Red Deer’s Inglewood neighbourhood.

Fleig was convicted of first degree murder in May 2012, but he appealed the verdict and was granted a new trial after he argued the trial judge made errors and misconstrued some key evidence.

The new trial was to take place last November but it was delayed over concerns about Fleig’s mental state. Fleig was found fit to stand trial following a psychiatric evaluation.

The trial was then supposed to get underway this past Thursday, June 1. However, it again was delayed after court learned that Fleig’s lawyer, Allan Fay of Calgary, withdrew from the case.

In Red Deer court on Monday, Fleig appeared to be off the medication he takes to treat his bipolar disorder and was acting confused, mumbling inaudibly when spoken to by Queen’s Bench Justice D.A. Mah.

The matter was stood down briefly and Fleig was removed from the courtroom before returning about 15 minutes later. Fleig was eventually able to confirm that he will be representing himself at his next trial.

The Crown requested six weeks for trial. It has been scheduled for January 9 – February 15, 2019.
