Calgary gang leader free, judge stays murder charge over trial delay

CALGARY – The Crown is appealing a judge’s ruling that allowed an accused gang leader charged with first-degree murder to walk out of a Calgary court a free man.

Nicholas Chan was arrested in the 2008 shooting death of Kevin Anaya, but the judge stayed the murder charge because the case took too long to get to trial.

Charges of conspiracy to commit murder and directing a criminal organization were also stayed.

The Crown is appealing the ruling and is seeking a new trial.
