Man shot by police in downtown Red Deer sentenced

The man involved in an incident last year in downtown Red Deer that ended with him being shot by an RCMP officer apologized in Red Deer court for his actions.

Jesse Dyvig, 29, pleaded guilty in August to charges of assaulting a police officer and possession of a dangerous weapon.

On Monday, he was sentenced by Justice James Glass to serve 90 days in jail.

It was on the night of May 1, 2016 that RCMP responded to reports of a suicidal man with a gun at the River Valley apartments on 49 Street.

Officers arrived to find the man in a second-floor hallway. That’s when the man pointed what appeared to be a revolver at RCMP members. He was shot in the chest and was taken to hospital with non-life threatening injuries.

The firearm Dyvig was wielding during the incident turned out to be a pellet gun. An ASIRT investigation later cleared the officer who fired the shot of any wrongdoing.

Dyvig later admitted that he had consumed six beers on the night of the incident, had taken pain medication, and hadn’t slept in several days. He told medical staff at the hospital that he didn’t blame the officer for shooting him and had wished to die.

A psychiatric report concluded that the incident was brought on by Dyvig’s alcohol addiction, not psychosis.

During his sentencing hearing on Monday, court heard Dyvig has been taking steps to get his life together since the incident took place. He’s sought treatment for his alcohol and drug addictions, has found new living accommodations in Springrbook along with a part-time job. He’s also started rebuilding his relationship with his parents and has a new girlfriend.

Dyvig was given an intermittent sentence, which he will serve two days a week from Sunday evening through Tuesday evening, allowing him to continue seeking addiction and mental health treatment and to keep working. He was also given 18 months’ probation during which he must abstain from consuming alcohol and non-prescription drugs. Dyvig was also given a three-year firearms ban and ordered to submit a DNA sample.

Dyving will begin serving his sentence this weekend.
